Elder Financial Abuse in Santa Maria: Acting Before More Was Lost
The Situation
A 74-year-old Santa Maria widow had been introduced to a financial advisor through a church acquaintance. Over 18 months, the advisor persuaded her to roll over her entire IRA and brokerage accounts into high-commission annuity products that were grossly unsuitable for her age and liquidity needs. She discovered the problem when she needed funds for a medical procedure and was told she would face surrender penalties of over $30,000 to access her own money.
Our Approach
We pursued claims under EADACPA and the California Elder Abuse and Financial Fraud Protection Act, as well as securities fraud claims against the advisor and his broker-dealer. We engaged a financial expert to document the unsuitability of the products and the advisor's commission structure. We coordinated with the California Department of Financial Protection and Innovation on the regulatory side.
The Outcome
The broker-dealer settled for full recovery of the surrender penalties and advisory fees plus attorney fees under EADACPA. The regulatory complaint resulted in disciplinary action against the advisor. Her accounts were restructured into age-appropriate instruments by a court-approved independent fiduciary.
