Protecting Older Adults in North Santa Barbara County

Santa Maria is the largest city in Santa Barbara County and serves as a regional hub for North County residents. The city has a substantial older adult population, including longtime agricultural community families and retirees who settled in the area for its affordability relative to coastal communities. Elder financial abuse cases in Santa Maria are filed with Santa Barbara County Adult Protective Services and civil claims are brought in Santa Barbara County Superior Court.

California's Elder Abuse and Dependent Adult Civil Protection Act provides strong remedies for victims and their families. Under Welfare and Institutions Code section 15657.5, a plaintiff who prevails on a financial abuse claim recovers attorney's fees and costs from the defendant as a matter of right. This fee-shifting provision makes it economically practical to pursue claims across a wide range of financial loss amounts, which would otherwise be too costly to litigate. We handle these matters for Santa Maria area families from our downtown San Luis Obispo office, and most consultations are conducted by phone or video.

Elder Financial Abuse in Santa Maria: Acting Before More Was Lost

The Situation

A 74-year-old Santa Maria widow had been introduced to a financial advisor through a church acquaintance. Over 18 months, the advisor persuaded her to roll over her entire IRA and brokerage accounts into high-commission annuity products that were grossly unsuitable for her age and liquidity needs. She discovered the problem when she needed funds for a medical procedure and was told she would face surrender penalties of over $30,000 to access her own money.

Our Approach

We pursued claims under EADACPA and the California Elder Abuse and Financial Fraud Protection Act, as well as securities fraud claims against the advisor and his broker-dealer. We engaged a financial expert to document the unsuitability of the products and the advisor's commission structure. We coordinated with the California Department of Financial Protection and Innovation on the regulatory side.

The Outcome

The broker-dealer settled for full recovery of the surrender penalties and advisory fees plus attorney fees under EADACPA. The regulatory complaint resulted in disciplinary action against the advisor. Her accounts were restructured into age-appropriate instruments by a court-approved independent fiduciary.

Who handles elder abuse reports in North Santa Barbara County?+
Reports in this area go to Santa Barbara County Adult Protective Services at (805) 681-4400. You can also contact law enforcement or call 911 for emergencies. An APS report and a civil legal claim can proceed simultaneously. If you are unsure whether what you are observing constitutes abuse, we can help you assess the situation during a free consultation before you decide on next steps.
Can a civil elder abuse claim be filed even if the elder did not want to report it?+
This is one of the most common and difficult elder law situations. A competent adult has the right to decline legal action. However, when the elder lacks capacity, family members or a court-appointed conservator may bring claims on their behalf. When an elder has passed away, the personal representative or successor trustee can file claims under EADACPA without the elder's consent. We evaluate the specific circumstances and explain what options are legally available.
What is Medi-Cal planning and why does it matter?+
Long-term care in North Santa Barbara County runs $120,000 to $160,000 per year or more in a skilled nursing facility. Medi-Cal can cover these costs for qualifying individuals, but eligibility rules are specific and the five-year lookback period for asset transfers catches many families unprepared. Medi-Cal planning involves structuring assets, income, and estate documents in a legally compliant way that preserves eligibility and protects as much of the estate as possible. We advise families before and during the application process.
Does the elder abuse civil claim survive if the elder has passed away?+
Yes. Under California law, a civil claim under EADACPA survives the elder's death and can be brought by the personal representative or successor trustee of the estate. Many elder financial abuse cases are discovered during estate administration when the full picture of what occurred becomes visible. The statute of limitations is generally four years from the date of discovery, so prompt action is important.
