Elder Financial Abuse in Nipomo: Acting Before More Was Lost
The Situation
A 78-year-old Nipomo Mesa property owner who lived alone had a neighboring family that gradually began helping with errands and home maintenance. Over two years, one family member persuaded her to add him as joint tenant on her deed and to change her bank account to a joint account. The elder's nephew discovered these changes when visiting from out of state and noticed her living conditions had deteriorated.
Our Approach
We filed for emergency intervention in SLO County Superior Court to sever the joint tenancy on the deed, which restored her as sole owner pending a full investigation. We filed a civil complaint under EADACPA and coordinated with SLO County Adult Protective Services. We also pursued the financial institution for its role in allowing an elderly woman to restructure accounts without adequate safeguards.
The Outcome
The deed was severed and the neighbor removed as joint tenant within 21 days of filing. The civil claim settled for recovery of documented financial damages plus attorney fees under EADACPA. APS completed a safety plan. An estate plan with appropriate capacity protections was put in place.
