Elder Financial Abuse in Avila Beach: Acting Before More Was Lost

The Situation

A retired Avila Beach property owner in her mid-70s was approached by a distant relative she had not seen in years. The relative positioned himself as reconnecting out of genuine family interest but quickly began acting as an informal financial advisor, persuading her to add him as a co-signer on accounts and directing her to make several large wire transfers he described as investment opportunities. By the time her estate planning attorney flagged the situation, over $85,000 had been transferred.

Our Approach

We filed a civil complaint under EADACPA targeting the relative and the investment scheme he had directed funds toward, which had elements of fraud as well as elder abuse. We engaged a forensic accountant to trace all transferred funds and identify any recoverable assets. We coordinated with APS and worked with law enforcement on the parallel criminal investigation. We also sought a prejudgment writ of attachment to preserve any assets that could be recovered.

The Outcome

The civil case recovered $62,000 of the $85,000 through the EADACPA claim and attachment of the relative's personal assets. A criminal restitution order addressed the remainder. The elder's estate plan was updated and a professional fiduciary was appointed as her durable power of attorney with reporting obligations to her family.
