California's Elder Abuse and Dependent Adult Civil Protection Act provides strong remedies for victims and their families. Elder Financial Abuse in Pismo Beach: Acting Before More Was Lost
The Situation
A 73-year-old Pismo Beach widow had been introduced through a senior center to a new companion who moved in after only three months. Within a year, the companion had persuaded her to update her estate plan to remove her two adult children and leave her Pismo Beach property and investment accounts entirely to the companion. One son discovered this when he visited and the elder seemed fearful and confused about her own financial situation.
Our Approach
We pursued a dual approach: a will and trust contest based on undue influence and lack of testamentary capacity at the time of signing, and a civil EADACPA complaint against the companion. We engaged a geriatric psychiatrist to assess the elder's capacity at the time the estate plan changes were made. We also filed for an emergency conservatorship to remove the companion's authority and restore the elder's access to her own funds.
The Outcome
The emergency conservatorship was granted within 14 days. The revised estate plan was successfully contested based on undue influence, and the prior plan naming her children was reinstated. The companion was removed from the home. The elder's estate plan was redesigned with appropriate capacity protections and family oversight built in.
