California's Elder Abuse and Dependent Adult Civil Protection Act provides strong remedies for victims and their families. Elder Financial Abuse in Los Osos: Acting Before More Was Lost
The Situation
A 79-year-old Los Osos resident had hired a home caregiver who had also begun managing her grocery shopping, prescription pickups, and mail. The caregiver was using the elder's debit card for personal purchases and had redirected several bills to go paperless, eliminating the paper trail. The elder's son, who visited monthly from San Jose, noticed cash was missing from her home and that her bank balance was much lower than expected.
Our Approach
We filed a civil complaint under EADACPA and engaged a forensic accountant to reconstruct 18 months of unauthorized transactions from bank records. We coordinated with SLO County APS and filed an administrative complaint against the caregiver's home care agency. We obtained a prejudgment attachment against the caregiver's assets to prevent further dissipation.
The Outcome
The caregiver settled the civil claim for full recovery of $28,000 in documented unauthorized charges plus attorney fees. The home care agency contributed to the settlement under agency liability. A new caregiver was vetted through a professional registry and a monitoring system was set up with the son to provide monthly financial oversight.
