Elder Financial Abuse in Cambria: Acting Before More Was Lost
The Situation
A 77-year-old Cambria homeowner whose spouse had died two years prior had been relying on her nephew to manage her finances after she developed mobility limitations. When her estranged daughter visited from out of state, she discovered that the nephew had added himself to the home's deed as a joint tenant, transferred $34,000 from her savings, and was paying himself $3,500 per month from her accounts as compensation he had never formally disclosed.
Our Approach
We filed an emergency petition to sever the joint tenancy on the Cambria property and simultaneously filed a civil EADACPA complaint against the nephew. We documented the self-dealing payments through bank records and established that the elder had never formally authorized compensation. We coordinated with SLO County APS and obtained an immediate freeze on further account transfers.
The Outcome
The deed was severed within 18 days of filing. The civil claim settled for $34,000 in actual damages plus $42,000 in retroactive "compensation" he had taken without authorization, plus attorney fees under EADACPA. An independent fiduciary was appointed as the elder's durable power of attorney. A complete estate plan was prepared with appropriate oversight provisions.
